Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HealthCareSim website and clinical simulation platform (collectively, the "Services") operated by HealthCareSim LLC ("HealthCareSim," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

Use of Services

Our Services are designed for use by nursing education programs, healthcare training institutions, and their authorized users. You agree to use the Services only for lawful educational purposes and in compliance with these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.

Institutional Accounts

Access to the HealthCareSim platform is provided through institutional licensing agreements. The institution is responsible for managing user access, including adding and removing authorized users, and for ensuring that its users comply with these Terms.

Acceptable Use

You agree not to:

  • Use the Services for any purpose other than authorized educational activities
  • Enter real patient data into the simulation platform
  • Attempt to gain unauthorized access to any part of the Services or related systems
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Share your account credentials with unauthorized individuals
  • Use the Services in any way that violates applicable laws or regulations

Simulated Data

All patient data within the HealthCareSim platform is simulated and fictional. It is designed for educational purposes only and does not represent real patients, medical records, or clinical outcomes. Users should not rely on simulated data for actual clinical decision-making.

Intellectual Property

The Services, including all content, features, and functionality, are owned by HealthCareSim LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.

Content created by institutions and users within the platform (such as custom scenarios and assessments) remains the property of the institution that created it.

Availability and Modifications

We strive to maintain reliable access to our Services but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Services at any time with reasonable notice to affected institutions.

We may update the Services from time to time to add features, fix issues, or improve performance. We will make reasonable efforts to communicate significant changes to institutional administrators.

Data and Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Each institution's data is logically isolated within the platform. Institutional data is not shared with other institutions or used for purposes beyond providing and improving the Services, except as described in our Privacy Policy.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. HealthCareSim does not warrant that the Services will be error-free or uninterrupted.

The Services are educational tools and are not intended to replace clinical judgment, professional medical training, or supervised clinical experience.

Limitation of Liability

To the fullest extent permitted by law, HealthCareSim LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of or in connection with your use of the Services.

Our total liability for any claims arising under these Terms shall not exceed the amount paid by your institution to HealthCareSim in the twelve months preceding the claim.

Termination

Either party may terminate the institutional licensing agreement in accordance with its terms. Upon termination, access to the platform will be revoked and institutional data will be handled in accordance with the licensing agreement and our data retention policies.

We may suspend or terminate individual user access immediately if we reasonably believe the user has violated these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Ada County, Idaho.

Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify institutional administrators and update the effective date at the top of this page. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
